Invoice Terms
Thank you for choosing Ferguson Custom for your lawn care and landscaping needs. The following terms apply to all invoices and services:
1. Payment Terms
- Payment is due upon completion of work and no later than 15 days of the invoice date (Net 15).
- We accept cash, check, credit/debit cards, and electronic payments (ACH – preferred for recurring services).
- A 4% convenience fee may apply to credit card payments.
2. Late Fees & Collections
- Invoices not paid within 15 days are considered past due.
- A late fee will be assessed at 16 days of 6% and there-after a late fee of 1.5% per month (or 18% annually) will be added to all past-due balances on the 1st of every month.
- Once past due, we reserve the right to suspend services and/or pursue collection actions. The client is responsible for all collection costs, including reasonable attorney’s fees.
3. Estimates & Pricing
- All estimates are valid for 30 days from the date of issuance.
- The final invoice may vary based on actual materials used, time required, site conditions, or additional work requested and approved by the client.
- Any changes or additional work must be agreed upon in writing prior to performance.
4. Service Guarantees & Warranty
- We stand behind our work. If you are not satisfied with the service provided, please notify us within 3 days of completion.
- Fertilizer, weed control, and pest treatments carry manufacturer’s warranties only. Ferguson Custom is not responsible for damage caused by weather, pets, improper maintenance by the client, or acts of God.
5. Cancellations & Rescheduling
- Cancellations or rescheduling requests must be made at least 24 hours in advance.
- Same-day cancellations may result in a trip charge of $75.
6. Property Access & Conditions
- The client grants Ferguson Custom and its crew reasonable access to the property to perform the agreed services.
- The client is responsible for removing obstacles (toys, furniture, vehicles, pets, etc.) from work areas prior to service.
- Ferguson Custom is not liable for damage to items left in the work area.
7. Lien Rights
- In accordance with Missouri law, Ferguson Custom reserves the right to file a mechanic’s lien on the property for any unpaid balances.
8. Governing Law
- These terms shall be governed by the laws of the State of Missouri. Any disputes shall be resolved in the courts of Greene County, Missouri.
